Placement conditions

Conditions to Placement Agreement

The following placement conditions apply when adopting a dog or cat from the Hague Animal Center.

The ownership of the animal described in the agreement (hereinafter referred to as “animal”) shall remain with the Hague Animal Center Foundation for six months. After this period, ownership shall pass to the buyer six months after placement, provided the following conditions are met:

  • The animal shall be given adequate freedom and exercise, properly fed, and receive proper housing and care during these six months, all at the sole discretion of the Hague Animal Center;

  • there has been no violation of the provisions of Article 2 during this period.

It is always prohibited, even after the period of six months after placement:

To

  • a. transfer the animal in ownership or otherwise to third parties (with or without compensation), without prior permission from the Hague Animal Center;
  • b. to breed with the animal described in the agreement;
  • c. to deprive the animal of the necessary freedom, food, exercise, housing or care;
  • d. to offer the animal for euthanasia without medical indication and without prior permission from the Hague Animal Center;
  • e. to provide animals with animal-unfriendly means, such as a slip-chain, halti, gentle leader, half-check (collars with chain between the ends), anti-tugging device or other similar means.

In case of violation of the provisions of Article 2, the buyer shall immediately owe a fine of €500. In addition, if the buyer violates Article 2 paragraph b, the animals thus bred shall remain the property of the Hague Animal Center. In that case, the Hague Animal Center has the right to reclaim the animal(s) and terminate the agreement, without restitution of the purchase price or other costs paid by the buyer.

The Hague Animal Center shall not be liable for any damage or costs caused by or on account of the animal after the conclusion of the agreement.

If the animal is a dog, the municipally levied dog tax shall be the buyer’s responsibility. Buyer is responsible for filing their own dog tax return.

The Hague Animal Center and all of its employees or persons designated by it for that purpose, are authorized at all times and places to supervise compliance with the terms and conditions set forth in the agreement.

In the case of physical defects which become apparent after the conclusion of the agreement and of which the Hague Animal Center could or should reasonably have been aware, the Hague Animal Center shall be obliged to take back the animal and refund the purchase price, without interest. Furthermore, the Hague Animal Center cannot be held liable.

In case of any expenses that the buyer would have to incur in case of Article 7, the buyer shall first seek permission from the Hague Animal Center.

Animal showing an unknown physical defect within fourteen days of the conclusion of the contract may be presented by the buyer, after telephone appointment, for treatment at no charge to the veterinarian of the Hague Animal Center.

The personal data included in this form will be recorded in a register of persons according to the General Data Protection Regulation. In addition, the Hague Animal Center sends the data of the buyer and the animal to the NDG (Nederlandse Databank Gezelschapsdieren) for chip registration. Furthermore, the Hague Animal Center uses the personal data for follow-up checks and sharing information about its operations.

The buyer knows that when purchasing a dog, he must comply with the legislation in force for chipping, registering and maintaining the EU pet passport for dogs. Furthermore, the buyer declares that if he decides to contact the former owner of the animal, as listed in the EU dog animal passport, he does so at his own risk and responsibility.

The buyer may return the animal to the Hague Animal Center free of charge for up to six months after placement. In this case, no distance fees will be charged. If the buyer returns the animal after the six months, the buyer will owe the then-current distance charges. In both cases, the buyer will always continue to pay the administration fee of €25.
